  8.     James Beall, referred to herein as "MAKER", agrees to pay to
  9. the  Order of Duane Carroll, referred to herein as "HOLDER", or
  10. order, the sum  of $2000, ( two thousand & no/100 Dollars), at 456
  11. Texarkana Avenue, Carrollton, TX  76543, with interest thereon at 
  12. rate of 9% per annum, simple interest.

  15. Said note shall be in due, unless earlier accelerated, in 12 
  16. installments, payable every 30 days, in the amount of $ 200, ( two
  17. hundred & no/100 Dollars). All payments received shall be credited
  18. first to interest and then to principal. Should MAKER fail to pay
  19. any installment when due, then HOLDER shall have the option to
  20. accelerate the payment of the full principal sum and accrued
  21. interest payable. HOLDER shall have the right for commercially
  22. reasonable causes, including but not limited to, the institution
  23. of litigation, the filing of tax liens, or any other objective
  24. sign of incapacity of the MAKER to pay the principal or interest
  25. due, to accelerate the payment of the full principal sum and
  26. accrued interest payable.

  30. This note is payable in U.S. Dollars. At any time the maximum 
  31. rate of interest applicable to this transaction shall not exceed 
  32. the legal maximum rate of interest for a note of this type. Any 
  33. sums paid in excess of any lawful limitation shall be applied to 
  34. principal.

  36. After default herein, this note will bear interest at the highest 
  37. legal rate for this type of note until paid in full. Upon any 
  38. default, MAKER agrees to pay a reasonable attorney's fee for any 
  39. and all services of an attorney, whether in or out of court, and 
  40. for appeal and post-judgment collection legal services.

  49.                 PERSONAL GUARANTEE

  51. The undersigned, in consideration of the extension of credit by 
  52. HOLDER to MAKER, unconditionally personally guarantee the full 
  53. and prompt payment of principal, interest, and any collection 
  54. costs, including attorney's fees to HOLDER. The undersigned 
  55. consent to any extensions which may be made from time to time 
  56. between MAKER and HOLDER, and consents to the release or 
  57. substitution of any collateral.
